Terms

The short version: quote our numbers freely and credit them honestly. They are one lab's measurements, published as they came out — not a promise from any vendor, and not advice.

Last updated August 27, 2026.

Using this site means you accept these terms. If you do not accept them, please do not use it.

The long version is below. It is longer than the rest of the site on purpose: we publish measured comparisons of products other companies sell for money, and both sides deserve to know exactly where the lines are.

The short version

What these numbers are
BenchAlert publishes numbers we measured ourselves. They come from one lab machine, one connection, and the published recipe and validation rules. They are not a promise from Anthropic, OpenAI, or xAI. Do not call any board here the official speed of a model, and do not present it as a vendor statement.
What you may do
Read, quote, screenshot, and link these numbers — at work, in a blog post, in a purchase memo, anywhere. That is why we publish them. The JSON feeds, the live badge, and the RSS feed are open to everyone — no key, no account. Speed results update as the current batch progresses.
What you may not do
Do not edit a number and keep our name on it. Do not resell our data as your own benchmark. Do not use our name or mark in a way that suggests we tested, endorsed, or partnered with your product. The Terms page has the rest of those rules.
Other companies' names
Claude, Codex, and Grok are products of Anthropic, OpenAI, and xAI. Those names, and every model name on our boards, belong to their owners. We use the names only to say which tools we tested. None of those companies sponsors this site, reviews it, or has any say in what it publishes.
No promises
The site and the data are provided as-is, with no uptime promise. The lab machine can be down, a vendor can be down, and a board can be empty. Runs fail, apps change, and we can be wrong. There is no warranty, and our liability is capped — the Terms page has the exact words. Read it before you ship a claim.

01

These terms, and who they are between

These terms are an agreement between you and DURK ENTERPRISES LLC, a limited liability company registered in Wyoming, United States, which runs BenchAlert.

We do not publish a postal address. Email is the way in, and we answer it. Write to team@benchalert.com.

"The site" means benchalert.com and everything we publish through it: the pages, the boards, the daily report, the JSON feeds, the live badge, and the RSS feed. "You" means the person reading, and any company you are reading for.

Using the site means you accept these terms. If you do not accept them, stop using it. There is nothing to cancel — there is no account.

02

What the numbers are, and what they are not

Everything on the boards is a measurement we took ourselves, and the exact conditions matter more than the figure does.

One lab
One machine, one home internet connection, one place, one set of paid accounts we bought at the normal price. A different machine or a different network would produce different numbers.
One method
Fixed prompts, pinned model names, exact command flags, a clean empty folder, and one attempt per round. All of it is written down on How we test, and every rule change bumps the test kit version stamped on the board.
One point in time
A number is a snapshot of the moment it was taken. Time of day, our network, a vendor's load, an app update, or a plan limit can all move it, and none of those are things we control.
Not complete
We test three tools and a short list of models. We do not test everything those tools can do, we do not test everything you would care about, and we make no claim that these numbers are complete, representative, or fit for any purpose of yours.
Not current forever
Vendors change models, prices, and plan limits without telling anyone in advance. A figure here can be out of date the day after we publish it.
Not official
No vendor supplies, approves, reviews, or checks any figure on this site before you see it.

03

Not advice

Nothing on this site is investment, financial, legal, tax, purchasing, or any other kind of professional advice. It is a set of measurements and what we think about them.

Do not make a buying decision, a contract decision, or an investment decision on these numbers alone. Try the tools yourself, on your own work, before you spend money.

04

Honest findings, and honest opinion

Every figure here is what our equipment recorded, published in good faith, with the method that produced it written down beside it.

Where we rank, compare, grade, or comment on what the numbers show, that is our opinion. It is honestly held, it is drawn from the stated method and the data behind it, and it is offered on a subject of real public interest to the people who pay for these tools.

We are describing measurements of software on one machine. We are not making a claim about the character, honesty, or conduct of any company or any person. A slow round is a slow round in our lab, not an accusation.

We correct mistakes. If a figure is wrong, we fix it, we say what changed, and we date it.

05

If you are a vendor and a number looks wrong

Write to us at team@benchalert.com. Tell us which board, which model, the date and time window, and what you believe the right figure is.

We will pull the raw log for that window, answer you, and correct the number in the open if we got it wrong. Corrections are dated and kept, not quietly swapped.

We will not remove a figure our own data supports, and we will not publish a figure we did not measure. This route is free, it is fast, and we would like you to use it first.

06

Quoting our numbers

We publish these figures so that people can use them. Quote them in a blog post, a purchase memo, a deck, a news story, or an internal review.

What you must do
Name BenchAlert as the source. Say which window and which test kit version the figure came from. Link the page you took it from. Keep the figure exactly as we published it.
What you must not do
Do not change a number and keep our name on it. Do not crop a chart so it says the opposite. Do not drop the window or the date that gives the figure its meaning. Do not present our figure as a vendor's official number, and do not imply we tested, endorsed, reviewed, or partnered with your product.
Where quoting stops
This permission covers figures and short extracts, with credit. It is not permission to republish the site, to copy our pages or their wording wholesale, or to take the data in bulk and stand it up somewhere else. That needs our written permission — ask, and we will usually say yes.

07

The open feeds

The JSON endpoints, the live badge, and the RSS feed are open to everyone. No key, no account, no sign-up.

They are provided as-is. We may change their shape, rename them, or switch them off at any time, without notice. Do not build anything you cannot afford to have break.

Our numbers move about once an hour. Polling faster gains you nothing and costs us something, so please do not.

08

Acceptable use

Short list, and none of it is a surprise.

Do not burden the service
No scraping, crawling, or automated requests at a rate that slows the site down or degrades it for other readers. Polite, cached, reasonable requests are welcome.
Do not resell our work as yours
Do not sell, license, or publish our data as your own benchmark, your own research, or an original work.
Do not misrepresent a number
No edited figures, no misleading crops, no missing windows, and no using our numbers to say something we did not measure.
Do not borrow our name
Do not use the BenchAlert name or mark in a way that suggests we tested, endorsed, or partnered with anything of yours.
No security testing without permission
No scanning, probing, penetration testing, or attempts to reach the operator console or any gated endpoint, unless we have said yes in writing first. Found a problem by accident? Tell us.
Nothing unlawful
Do not use the site in any way that breaks the law where you are, or that helps anybody else do so.

09

What you send us

The only thing you can send through the site is a take on a tool: which tool, and a one-word vote. There is no free text box, on purpose.

By sending it, you give us a worldwide, royalty-free, non-exclusive, perpetual, irrevocable licence to store it, publish it, and show it — on its own or counted together with everybody else's.

We are not obliged to publish anything you send, and we may remove or stop showing any submission at any time, for any reason.

Do not send us anything confidential, anything personal, or anything that is not yours to send.

If you email us about a figure, we may quote your message when we publish a correction, unless you ask us not to.

10

Our content

The words, pages, design, code, charts, and the BenchAlert name and mark belong to us. Measurements are facts and nobody owns a fact — but the way we select, arrange, present, and explain them is our work, and it is protected.

Nothing on this page gives you a licence to our brand beyond the credit line above.

11

Other companies' names, and links out

Anthropic, Claude, and Claude Code; OpenAI, ChatGPT, and Codex; xAI, Grok, and Grok Build — those names, logos, and every model name on our boards belong to their owners.

We use them for one reason: to say which product we tested. That is nominative use. It is not a claim of any relationship.

BenchAlert is independent. It is not affiliated with, sponsored by, endorsed by, reviewed by, or in partnership with Anthropic, OpenAI, or xAI. None of them funds the lab, and none of them sees a number before you do.

We link to other sites. We do not control them, we do not check them, and we are not responsible for what is on them or what they do with your data.

12

No warranty

The site, the data, and the feeds are provided "as is" and "as available", with all faults.

To the fullest extent the law allows, we disclaim every warranty, condition, and term of any kind, whether express or implied — including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, title, and non-infringement, and any warranty arising from a course of dealing or from trade usage.

We do not warrant that the site will be available, uninterrupted, timely, secure, or error-free, or that any figure on it is accurate, complete, current, or suitable for anything you plan to do with it.

Some places do not allow these exclusions, so parts of this may not apply to you. Where a warranty cannot be excluded, it is limited to the shortest period and the narrowest scope the law allows.

13

Limit of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, lost revenue, lost data, lost goodwill, lost business, or the cost of substitute services — however caused, on any theory of liability, and even if we had been told such a loss was possible.

Our total liability for every claim arising out of or relating to the site or these terms, taken together, will not exceed the greater of: what you have paid us in the twelve months before the claim, which for a free public site is normally nothing; or one hundred US dollars.

Nothing here limits liability that cannot be limited by law — including death or personal injury caused by our negligence, fraud, and fraudulent misrepresentation.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so parts of this may not apply to you.

These limits survive the end of these terms, and they apply even if a limited remedy is found to have failed its essential purpose.

14

If your use of the site costs us

You agree to defend, indemnify, and hold harmless the operator, and anyone working with us, against any claim, loss, liability, damage, and reasonable legal cost arising out of: your use of the site; your breach of these terms; your misuse or misrepresentation of anything we published; or your infringement of anyone else's rights.

We may take over the defence of any such claim at our own cost, and if we do, you will co-operate with us.

15

Changes to the site

We may change, pause, or stop any part of the site — a board, a feed, a page, or all of it — at any time, with or without notice.

We may also pause a model we track, and the board will say so. A pause is an operational fact about our lab, never a comment on the tool.

16

Changes to these terms

We may update these terms. When we do, the date at the top changes, and a real change also gets a dated line in the Changelog.

If you keep using the site after a change, you accept the new terms. If you do not accept them, stop using the site.

17

If we disagree

Write to us first, at team@benchalert.com. Most disagreements about a number are settled by looking at the raw log together, and that costs neither of us anything.

Please give us 30 days from that message to put things right before you start anything formal. We will use the same 30 days before we do.

18

Governing law, and where a dispute is heard

These terms, and any dispute or claim arising out of them or out of the site — including non-contractual ones — are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules.

The state and federal courts sitting in Sheridan County, Wyoming have exclusive jurisdiction, and both sides agree to submit to them.

If you are a consumer, the law of the country you live in may give you rights, and a local court, that no clause here can take away. Nothing in this section removes them.

19

The rest

Severability
If a court finds any part of these terms unenforceable, that part is narrowed to what is enforceable, or cut, and everything else stays in force.
No waiver
If we do not enforce something straight away, we have not given up the right to enforce it later.
Entire agreement
These terms, together with the Privacy page, are the whole agreement between us about the site, and they replace anything said before.
Assignment
You may not transfer your rights under these terms. We may transfer ours to a successor of the site or the business, and these terms follow.
No third-party rights
Nobody other than you and us can enforce these terms, except the people we are allowed to indemnify under the section above.
Events outside our control
We are not liable for failing to do something when the cause is outside our reasonable control — a vendor outage, a network failure, a power cut, or anything of that kind.
Headings
The headings on this page are there to help you read it. They do not change it.

20

How to credit us

“BenchAlert, SpeedBench fixed-payload v1, batch [ID], observed [date].”

Include the method, batch ID and observation date, and link the page or endpoint you took the number from.

BenchAlert is run by DURK ENTERPRISES LLC. If these terms change, the date at the top of this page changes with them.
